Judgment Enforcement

HPPC can register a writ with any jurisdiction that the debtor may owe land preventing the debtor from purchasing, selling or mortgaging the property before paying out the judgment.

Obtaining a judgment does not mean that the person or company whom the judgment was awarded against will pay you immediately or that you will ever see what you were awarded.  Simply, a judgment is not an assurance that you will receive what you are entitled to; however, it is an order which gives you the right to enforce it in many ways.

Having the right legal representation to help you enforce your judgment can only increase your chances of success.  We have the tools necessary to locate the debtor and the debtor’s assets.  It is necessary to determine whether the debtor has any assets to be seized and sold, any bank accounts or current employment where funds can be garnished.  Once located, we are then able to collect your judgment in the following ways:

  • Demand Payment - The judgment received can be enforced immediately; however, there are court costs associated with it so it is always better to demand payment from the debtor before commencing any enforcement process.
  • Judgment Debtor Examination Hearing – We would summon the debtor or a third party before the court and question him/her about the debtor’s assets.
  • Notice of Garnishment – We would file appropriate documentation with the court to demand payment from a third party, like an employer or bank that owes the debtor money, to pay you based on the court order.
  • Writ of Seizure and Sale of Personal Property – We would make a request to court for permission to seize and sell the debtor’s personal property in order to pay the judgment debt.
  • Writ of Seizure and Sale of Land – We would make a request to court to register a writ with any jurisdiction that the debtor may owe land preventing the debtor from purchasing, selling or mortgaging the property before paying out the judgment.
  • Writ of Delivery – We would make a request to court for enforcement officials to seize an item and return it to you as the legal owner.
  • We will also enforce judgments from other Tribunals such as the Landlord and Tenant Board.

Fees

Every case is different and unique in its own way.  As a result, we have determined that it would best benefit our clients if only upon reviewing the case can a fee be set and the type of payment arrangement for a specific matter.  We are open and willing to work with our clients to meet their situation at hand by providing

  • Hourly rate – We will charge you a specific amount for every minute we work on your file.
  • Blocked rate – We will set a flat fee to do a specific task, for example attending a Judgment Debtor Examination.
  • Contingency rate – We will set a percentage amount of which you will pay us from the funds we recover for you.

It is important to note that clients are responsible for their own disbursements, being your out of pocket expenses.  Examples of disbursements include, but are not limited to filing court documents, process serving, photocopying.
